Court office hours for all three divisions are Monday through Friday, 8:30 a.m. – 12:00 p.m. and 1:00 p.m. – 4:00 p.m. Each court is a court of general jurisdiction. However, there are specific exceptions to note: all juvenile delinquency cases are assigned to Warrick Circuit Court, small claims cases are divided between Superior Courts No. 1 and No. 2, and the Drunk Driving/Drug Court program is administered through Superior Court No. 1. A jointly appointed magistrate serves all three courts.
Are Court Records Public in Warrick County?

- Certain paternity records created between 1941 and 2014

- Guardian ad litem reports, parenting coordinator reports, and custody evaluation reports
- Medical and substance abuse treatment records compiled by a provider
- Photographs or recordings depicting a live individual’s uncovered intimate areas or sexual conduct
- Drug and substance abuse records governed by 42 CFR Part 2
Personal Information Protections
Rule 5© requires the redaction of complete Social Security numbers, account numbers, personal identification numbers, and passwords from public filings. Addresses, dates of birth, and phone numbers of witnesses and victims in criminal, juvenile, and civil protection order cases must also be excluded from public view. Documents containing such information must be filed as confidential (on green paper or as an e-filed confidential document), with a redacted version filed separately for public access.

Expungement
Under IC 35-38-9, Indiana allows eligible individuals to petition for the expungement or sealing of certain criminal records. Expunged records are removed from public access, and the Clerk’s Office will not disclose them in response to standard inquiries. Eligibility depends on the nature of the offense, the outcome of the case, and the passage of specific waiting periods. Arrest records that did not result in a conviction may be eligible for expungement at any time.
Additional Local Fees
Warrick County imposes additional felony and misdemeanor fees pursuant to local ordinance. The Clerk of the Warrick Circuit and Superior Courts assesses and collects a $10 fee and a $50 fee on top of other local and statutory fees in applicable criminal cases.

Warrick County Family Court Records
Family law cases in Warrick County — including dissolution of marriage, child custody, child support, paternity, domestic violence protection orders, adoptions, and guardianships of minors — are filed as domestic relations matters and distributed among the county’s three courts.
Dissolution of Marriage (Divorce)
Divorce filings in Warrick County are maintained by the Clerk’s Office. The public portions of a dissolution case typically include the petition, docket entries, and the final decree. However, financial settlements, child custody evaluations, and other sensitive materials may be restricted from public view under court order or by operation of Rule 5.

Child Custody and Support
Custody and parenting time orders, modification petitions, and child support payment records are part of the domestic relations case file. The Warrick County Clerk is responsible for receiving and distributing child support payments ordered by the court. The Indiana Child Support Bureau administers statewide enforcement activities.

Protective Orders

Birth certificate requests can also be submitted by emailing a completed Application for Birth Certificate along with a copy of valid photo ID to Lderr@warrickcounty.gov. A Death Certificate application form is also available. Birth certificates are issued to the individual named on the certificate, their parent or guardian, or a representative with a demonstrated legal interest. Death records are similarly restricted to immediate family or persons with a proven legal need.
Warrick County Probate Court Records
Warrick County does not have a standalone probate court. Probate matters are handled by the Warrick Circuit Court, whose jurisdiction encompasses wills, estate administration, guardianships of incapacitated adults, conservatorships, and related proceedings.
