Are Court Records Public in Morgan County?
Indiana's Access to Public Records Act (IC 5-14-3) sets a strong presumption that records created by government agencies, including courts, are open for public inspection. Most Morgan County case files, docket sheets, orders, and judgments can be reviewed by any member of the public without needing to state a reason.
That said, both statute and court rule carve out categories of information that must remain confidential or may be withheld. Indiana Administrative Rule 9 governs statewide public access to court records and identifies the following types of information as excluded:
- Social Security numbers, tax identification numbers, and financial account numbers (except for the last four digits)
- Records of juvenile delinquency and Child in Need of Services (CHINS) proceedings
- Mental health and substance-abuse treatment records
- Adoption records
- Records sealed by court order
- Victim information protected under statute (e.g., sexual assault or human trafficking survivors)
- Investigatory records whose disclosure could jeopardize an ongoing criminal case
- Grand jury proceedings
- Probation pre-sentence investigation reports
Administrative Rule 9, Section G also sets out procedures for filing confidential documents, requiring that such records be submitted on a separate form and properly designated so they don't appear in the public case file. If you believe a record has been improperly withheld, you can file a request with the court for access under Rule 9's access procedures; the record stays sealed until the court rules on the request.
Morgan County Criminal Court Records

The LCH report does not include arrests from other states, federal cases, or infractions. It also does not include expunged or sealed records.

Morgan County Civil Court Records
Civil litigation in Morgan County is divided between the Circuit Court, Superior Courts 1 through 3, and — for smaller monetary disputes — the Small Claims division within Superior Court 3. Morgan County Family Court Records
Family law matters — including divorce, legal separation, child custody, child support, paternity, protective orders, and adoptions — are divided among the Circuit Court and the three Superior Courts. Only eligible individuals — typically the record subject, a parent, spouse, child, sibling, grandparent, or authorized legal representative — may obtain certified copies. Morgan County Probate Court Records
Probate jurisdiction in Morgan County is shared between Superior Court 1 — which handles roughly half of all estate and probate cases — and the other divisions. The Probate Court handles administration of decedent estates, wills, trusts, guardianships, conservatorships, and related filings.
Estates
The Clerk's Office provides general guidance on the estates filing process. Indiana law distinguishes between small estates and supervised estates:
- Small estates: An estate valued at $100,000 or less (for decedents who died after June 30, 2022) after subtracting liens, encumbrances, and reasonable funeral expenses may be administered using a Small Estate Affidavit. Joint assets and beneficiary designations are excluded from the $100,000 calculation. At least 45 days must have passed since the date of death, and a death certificate is required.
- Supervised estates: Estates exceeding the small-estate threshold must be opened by an attorney and require a $177.00 filing fee (certified mail) or $205.00 (sheriff service), plus any applicable inventory fee.

Guardianships and Conservatorships
Petitions for guardianship or conservatorship of an incapacitated adult or a minor are filed through the Clerk's Office. These proceedings fall under the jurisdiction of Superior Court 1 and are subject to the standard probate filing fee.
