The county operates a Circuit Court and two Superior Courts, all housed at the Montgomery County Courthouse, together handling the full spectrum of criminal, civil, domestic relations, small claims, and probate cases. Are Court Records Public in Montgomery County?
Indiana’s Access to Public Records Act (APRA), codified at Indiana Code § 5-14-3, establishes that government records — including court records — are presumptively open to public inspection and copying. Any person may submit a request to inspect or obtain copies of public court records; no reason is required for the request.
That said, APRA contains specific exemptions. The following categories of court records may be withheld or restricted in Montgomery County:
- Records of crime victims under the age of 18
- Juvenile case records, which are confidential by statute
- Active law enforcement investigatory records
- Records containing trade secrets or proprietary business information
- Social security numbers, tax identification numbers, residential addresses, and other personal financial identifiers
- Medical and mental health records included in filings
- Records sealed or expunged by court order
- Records declared confidential by the Indiana Supreme Court or applicable state or federal statute
Requesters who are denied access to a record may challenge that denial through the Indiana Public Access Counselor’s office, which provides advisory opinions on APRA compliance at no cost.
