Marion County encompasses Indianapolis, the capital and most populous city in Indiana, and operates the largest trial court system in the state. The county’s courts include the Marion Superior Court — which is divided into Civil, Criminal, and Family divisions — the Marion Circuit Court, the City Court of Beech Grove, and nine township small claims courts. The Marion County Clerk’s Office serves as the official record keeper for these courts, managing case files, judgments, orders, filings, financial records, and marriage licenses. The Clerk also collects filing fees, court costs, bail bond monies, restitution, and child support payments ordered through the court.

Indiana residents and the public can search court records through several channels. The Indiana Judicial Branch maintains MyCase, a free, statewide case-search portal covering civil, criminal, family, probate, and other case types in every Indiana trial court, including all Marion County courts. The IndianaStateCourts.us domain may also assist users looking to locate publicly available court case information across the state. Beyond online tools, records are accessible through the Clerk’s two physical locations, where public terminals are available during business hours, and through a dedicated online records request portal operated by the Clerk’s Office.

How to Look Up a Court Case in Marion County?

Marion County court cases can be searched using three primary methods: online through MyCase, in person at a Clerk’s Office location, or by phone for urgent inquiries.

Online Search via MyCase:

  1. Go to the MyCase search page.
  2. Choose either the “Name”, “Case”, or “Attorney” tab.
  3. For a name search, enter the party’s last name and first name. Under the “Court” dropdown, select Marion County to filter results.
  4. Narrow results further by case type, case status, or filing-date range.
  5. Click any case title in the results list to view the case summary, party names, docket entries, scheduled events, and financial information.

Case number searches return a specific case record directly. Attorney searches can be conducted by name or bar number.

In-Person Access:

Public terminals connected to the court’s JUSTIS record system are available from 8:00 a.m. to 4:30 p.m. weekdays in Room W122 of the City-County Building and at the Community Justice Campus. Staff can also retrieve records when provided with a name or case number.

Urgent name-based searches may be conducted by calling (317) 327-4715 during business hours.

Copies and Fees:

  • Physical copies: $1 per page
  • Certification: $3 per document (regardless of page count)
  • A certified copy of a single-page document therefore costs $4
  • Accepted payment: cash, money order, cashier’s check, credit/debit card (nominal processing fee applies)
  • Personal checks are not accepted

Mail requests can be sent using printable forms available on the Clerk’s website for criminal case records, civil case records, juvenile records, marriage license records, divorce decree records, and name change records. Payment details are coordinated after the Clerk receives the request.

Are Court Records Public in Marion County?

Indiana law provides broad public access to court records. The Indiana Access to Public Records Act (APRA) guarantees the right of any person to obtain information about government activities and public officials. Rule 4 of the Indiana Rules on Access to Court Records reinforces this by establishing that the public may access all court records regardless of format, unless a specific exclusion applies.

Rule 5 identifies the categories of records that are excluded from public disclosure:

  • Records protected by federal or state laws
  • Confidential financial information
  • Mental health records
  • Personal information of litigants, children, or witnesses
  • Social Security numbers
  • Medical records
  • Records containing trade secrets
  • Paternity records
  • Adoption records
  • Juvenile records (with limited exceptions for parties to a proceeding)

  • Grand jury proceedings
  • Substance abuse treatment records
  • Expungement orders
  • Mediation proceedings, mini-trial proceedings, and summary jury trials

The Indiana Office of Public Access Counselor publishes the Public Access to Court Records Handbook, which explains in detail how the public may petition for access to records that have been excluded. The handbook also clarifies the distinction between records that are confidential by statute and records that a judge has sealed by order.

Juvenile records carry particularly strict access limitations. Viewing juvenile case files requires being a party of record and presenting valid identification in person. No information about pending juvenile actions, motions, payments, fees, or restitution will be released by phone, mail, or email.

Marion County Criminal Court Records

The Criminal Division of the Marion Superior Court handles all criminal charges filed by the Marion County Prosecutor’s Office. Jurisdiction covers misdemeanors, Level 6 (formerly Class D) felonies, major felonies, domestic violence cases, and drug-related offenses. All criminal proceedings take place at the Community Justice Campus.

Searching Criminal Court Cases:

Criminal case information can be retrieved through several methods:

  1. MyCase: Search by defendant name, case number, or attorney at mycase.in.gov. Non-confidential criminal docket information, charges, hearing dates, and dispositions are available at no cost.
  2. Online Records Request: Use the Clerk’s online records request portal for certified or uncertified copies of criminal case documents.
  3. In Person: Visit the Clerk’s Office at the Community Justice Campus or the City-County Building. Criminal records request forms are available on site and as printable downloads.
  4. Trial Court Calendar: The Marion County Trial Court Calendar shows impending criminal hearing dates, case numbers, and courtroom assignments.

Criminal History Records:

The Marion County Sheriff’s Office maintains county-level criminal history records. Requests may be submitted in person, by mail, by phone, or through the Sheriff’s online record request form.

For statewide criminal background checks, the Indiana State Police operates a centralized repository:

  • Name-based search: Available through the ISP Limited Criminal History portal at $15 per record ($15.70 by credit card). Results include Indiana felony and Class A misdemeanor arrests only. Users must create an account.
  • Fingerprint-based search: Provides a comprehensive record including all arrests, charges, and dispositions within Indiana. Appointments can be scheduled online or by phone at (877) 472-6917.

Criminal Filing Fees (per the Indiana Trial Court Fee Manual):

Total criminal case costs are $189 (or $217 when the $28 sheriff’s service-of-process fee is included). Infraction and ordinance violations total $139 ($167 with sheriff service).

Marion County Civil Court Records

Civil cases in Marion County are heard by three types of courts. The Civil Division of the Marion Superior Court (Courts D01–D07, D11–D13, IV-D, and OV) handles general civil matters, probate, and environmental proceedings. The Marion Circuit Court hears non-criminal civil cases and paternity matters. Nine township small claims courts handle disputes up to $10,000.

All civil cases filed with the Clerk for the Superior Court are randomly assigned to a courtroom. Attorneys are required to e-file; self-represented parties may file in person at the Clerk’s Office or e-file through Indiana’s electronic filing system.

Each additional defendant adds $10. Sheriff service of process is $28 per case (one-time), with an additional $28 available post-judgment, and $60 for non-Indiana cases. Accepted payment: cash, money order, attorney’s check, or credit/debit card.

The Clerk’s Office does not maintain small claims court records. Requests must be directed to the individual township court. The City Court of Beech Grove (340 E. Churchman Avenue, Beech Grove, IN 46107; Phone: (317) 803-9155) also handles certain misdemeanor and infraction matters within its jurisdiction.

Searching Civil Records:

Non-confidential civil case records are accessible on MyCase at no charge. The Clerk’s online records request portal can be used to request copies. In-person requests are accepted at both Clerk’s Office locations from 8:00 a.m. to 4:30 p.m. Monday through Friday.

Marion County Family Court Records

The Family Division of the Marion Superior Court (Courts D09, D10, D14, D15, D16, D22, and D24) hears all domestic relations and juvenile matters in the county. Case types include dissolution of marriage, adoption, guardianship of minors, juvenile delinquency, Child in Need of Services (CHINS), juvenile paternity, termination of parental rights, juvenile status offenses, and reciprocal support (handled by the Circuit Court).

Dissolution of Marriage:

Filing a dissolution petition costs $177. In cases involving children, both parties must be served along with a Visiting Nurses Brochure, and both parties are required to complete a parent education course. A Financial Declaration form should be prepared and served with the initial filing in all relevant family law matters. Copies of divorce decrees can be requested through the Clerk’s online records request portal, in person, or by mail using the printable divorce decree request form.

Marriage Licenses:

The Clerk’s Marriage License Division issues licenses at the City-County Building (Suite W122). Both applicants must appear in person with valid, unexpired photo identification and proof of residency.

The license is valid for 60 days and must be recorded with the Clerk within 30 days of the ceremony per IC 31-11-4-17. Applicants can begin the process through the online marriage license application before visiting the office to complete the review. Marriage records can also be searched through the Indiana Marriage License Public Lookup.

Protective Orders:

Protective orders can be filed at no cost at either Clerk’s Office location (Community Justice Campus or City-County Building) from 8:00 a.m. to 4:30 p.m. Monday through Friday. A qualifying relationship with the respondent is required (spouse, partner, blood or marriage relative, or the petitioner must be a victim of a sexual offense or stalking). Protection order petitions can also be filed electronically. After filing, a judge typically rules the same day. If granted, the Sheriff serves the order on the respondent. Advocacy organizations such as the Julian Center, Beacon of Hope, and the Indiana Coalition Against Domestic Violence offer assistance to petitioners.

Child Support:

Child support payments ordered through the court are collected and disbursed by the Clerk’s Office. The Child Support Division is located in the City-County Building, Suite W122 (fax: (317) 327-4813; email: marioncountychildsupport@indy.gov). Payment histories can be obtained through the Clerk’s child support records service, and copies of child support orders can be requested through the online records tool.

Birth and Death Records:

Birth and death certificates are not maintained by the Clerk’s Office. They are issued by the Marion County Public Health Department Vital Records Office:

Records can be obtained in person (walk-in, no form required), by mail (using the Birth Certificate Request Form or Death Certificate Request Form), or online through VitalChek (additional fees apply). Walk-in office hours include extended Wednesday hours; all other weekdays follow standard schedules. Credit and debit cards are accepted in person with a $2.00 convenience fee on purchases up to $100 and 3% on amounts over $100. Personal checks are not accepted. Only individuals with a direct interest or valid identification may obtain a birth or death record.

Statewide records are available through the Indiana Department of Health, Division of Vital Records (2 N. Meridian Street, Indianapolis, IN 46204; Phone: (317) 233-1325). The first certificate costs $8, with additional copies at $4 each.

Marion County Probate Court Records

Probate matters in Marion County are administered through the Civil Division of the Marion Superior Court, specifically Court D08. The Probate Department handles estate administration (supervised and unsupervised), wills, trusts, guardianships, mental health proceedings, and adoptions. All probate hearings take place at the Community Justice Campus.

Per the Indiana Trial Court Fee Manual, the base probate costs fee is $120 under IC 33-37-4-7, combined with document storage, automated record keeping, judicial salaries, and other statutory fees totaling $177 (or $205 with the $28 sheriff service-of-process fee).

Searching Probate Records:

Probate case information is accessible through MyCase by selecting the case type filter for probate matters. The Indiana Digital Archives also contains indexed historical probate documents for Marion County searchable by name.

In-person requests for probate records can be made at the Community Justice Campus or the City-County Building during business hours (8:00 a.m. to 4:30 p.m., Monday through Friday). A case number or party name is required. Certified copies cost $3 for certification plus $1 per page. Property Records:

While not part of the probate system, property records are often relevant in estate matters. The Marion County Assessor provides the Property Report Card search tool, and the Recorder’s Office maintains a Real Estate Record Online Search where recorded documents can be located by name, document number, or document type. Copy fees from the Recorder’s Office are $1 per page; certification is $5 plus copy fees. Copies are generally available within one business day.
