Grant County is located in central Indiana with its county seat in the city of Marion. The county’s judicial system operates through the Grant Circuit Court and three divisions of the Grant County Superior Court, all headquartered at the Grant County Courthouse at 101 East 4th Street in Marion. The Grant County Clerk of the Courts serves as the official custodian of court records, maintaining files for civil, criminal, family, and probate proceedings. Two city courts—Marion City Court and Gas City City Court—also handle local matters within their respective jurisdictions.

To search for a case, follow these steps:

  1. Online via MyCase. Visit mycase.in.gov and search by party name, case number, or attorney name. Many documents are available for viewing and downloading free of charge.
  2. In person. Visit the Grant County Clerk’s Office on the first floor of the courthouse during regular business hours. Staff can assist with locating case files. A photocopy fee of $1.00 per page applies to document copies, and certified copies carry additional certification charges.
  3. By mail. Submit a written request to the Clerk’s Office at 101 E. 4th Street, Marion, IN 46952. Include the case number or the full names of the parties, the approximate year the case was filed, and a self-addressed stamped envelope. Enclose the applicable copy fees by money order.
  4. E-filing portal. Attorneys must file documents electronically in Grant County. Self-represented parties may also e-file through authorized Indiana e-filing service providers.

Are Court Records Public in Grant County?

Indiana law establishes a strong presumption that court records are open to the public. The Indiana Access to Public Records Act (APRA), codified at Indiana Code § 5-14-3, defines public records broadly to include any writing, document, report, map, photograph, recording, or other material created, received, or maintained by a public agency. Court records fall within this definition, and any person may inspect and copy them subject to specific exceptions.

The Indiana Supreme Court supplements APRA with its own Rules on Access to Court Records. Under Access to Court Records Rule 5 (effective February 2, 2026), the following categories of records are excluded from public access:

  • Entire case exclusions: Mental health cases filed under I.C. 12-26; investigative requests and process unrelated to a pending criminal case (such as sealed search warrants); paternity records created between July 1, 1941, and July 1, 2014.
  • Individual document exclusions: Records declared confidential by federal law or Indiana statute; records subject to statutory or common-law privilege; medical records compiled by a healthcare provider; mental health treatment records; substance abuse records governed by 42 CFR Part 2; guardian ad litem reports, parenting coordinator reports, and custody evaluation reports; photographs or recordings depicting nudity or sexual conduct.
  • Personal information requiring redaction: Complete Social Security numbers of living persons; complete account numbers, PINs, and passwords. If such information is necessary to the case, the filer must submit a confidential version (on green paper for paper filing or marked confidential for e-filing) and a separate redacted public version, along with an ACR Form citing the specific Rule 5 grounds.
  • Temporarily excluded records: Criminal cases filed simultaneously with an arrest-warrant request remain confidential until the court rules on the exclusion request; the exclusion expires upon the defendant’s arrest.

Addresses, dates of birth, and phone numbers of witnesses or victims in criminal, juvenile, or civil protection order proceedings are also excluded from public access under Rule 5©(3). Court administrative records—including personal notes and deliberative materials of judges, jurors, and court staff—remain permanently confidential under Rule 5(D).

Grant County Criminal Court Records

Criminal cases in Grant County are heard by the Circuit Court and the three Superior Courts. Felony and misdemeanor charges are filed by the Grant County Prosecutor’s Office, and the Clerk of the Courts maintains the official case files. The Grant County Sheriff’s Office also provides public safety information, including a Sex Offender Registry listing active offenders within the county.

Searching criminal records. Non-confidential criminal case information—including charges, case status, hearings, and dispositions—is available on MyCase. In-person searches can be conducted at the Clerk’s Office.

Statewide criminal history. The Indiana State Police (ISP) maintains the state’s central repository for criminal history records. Two types of searches are available:

  1. Limited Criminal History (name-based). Includes felony and misdemeanor conviction data. Online searches cost $15.00 per record for subscribers or $15.70 per record by credit card via the ISP online portal. Mail requests require a completed LCH request form and payment sent to: Indiana State Police, Criminal History Limited Check, P.O. Box 6188, Indianapolis, IN 46206-6188.
  2. Full Criminal History (fingerprint-based). Includes all recorded arrests, charges, and dispositions within Indiana. Applicants can schedule a fingerprinting appointment through ISP. This option is often used for employment screening and licensing purposes.

Criminal court fees. Under Indiana Code § 33-37-4-1, the base criminal costs fee is $120.00. When combined with statutory surcharges (document storage at $5.00, automated record keeping at $20.00, judicial salaries fee at $20.00, jury fee at $6.00, and other mandatory assessments), total criminal case fees reach approximately $189.00, or $217.00 when the sheriff’s service-of-process fee of $28.00 is included. Grant County Civil Court Records

Civil cases in Grant County encompass lawsuits, contract disputes, property disputes, personal injury claims, evictions, and small claims matters. The Grant Circuit Court and Superior Courts share jurisdiction over civil matters, and the Clerk of the Courts maintains all filings.

How to obtain civil court records:

  1. Online. Search MyCase by party name, case number, or attorney. Most civil pleadings, motions, and orders are viewable at no cost. Downloading or printing specific documents may require registration.
  2. In person. Visit the Clerk’s Office during business hours. Staff can retrieve paper files or printouts from the electronic case management system.
  3. By mail. Submit a written request with identifying information (case number, party names, year filed) and applicable fees.

Civil filing fees. The base civil filing fee is $100.00 (I.C. § 33-37-4-4(a)). With statutory surcharges, the total reaches approximately $157.00, or $185.00 if the sheriff’s service-of-process fee of $28.00 is requested. Additional fees include:

  • Civil action service fee: $10.00 per additional defendant beyond the first named defendant
  • Garnishee defendant service fee: $10.00 per garnishee defendant in excess of three
  • Pro bono services fee: $1.00
  • Jury fee (for civil tort and civil plenary cases): $75.00

Small claims. The base small claims filing fee is $35.00 (I.C. § 33-37-4-6), with a $10.00 service fee per named defendant. Total small claims fees are approximately $97.00, or $87.00 when filed through the electronic filing system (which waives certain service fees). Property records. The Grant County Recorder’s Office maintains deeds, mortgages, liens, plats, and other land records. The office is located at 401 S. Office hours are Monday through Friday, 8:00 a.m. to 4:00 p.m. The Grant County Assessor’s Office provides property tax assessments and valuations.

Grant County Family Court Records

Family law matters in Grant County—including dissolution of marriage (divorce), legal separation, child custody, child support, paternity, domestic violence protection orders, adoptions, and guardianships of minors—are handled by the Circuit Court and Superior Courts. There is no separate family court division; these cases are distributed among the existing courts according to the county’s caseload allocation plan.

Divorce and dissolution records. Divorce decrees and related filings are maintained by the Clerk of the Courts and can be searched on MyCase or requested in person at the Clerk’s Office. The division handling divorce inquiries can be reached at (765) 668-8121. Filing a petition for dissolution of marriage requires paying the standard civil filing fee of approximately $157.00. Counties with an approved alternative dispute resolution plan may also assess a $20.00 ADR fee in dissolution, legal separation, and paternity cases (I.C. § 33-23-6-1).

Marriage licenses. The Grant County Clerk’s Office issues marriage licenses. Under Indiana law, both applicants must appear in person with valid identification proving date of birth. The fee is $25.00 for Indiana residents and $65.00 for out-of-state residents. Some offices charge an additional $4.00 document fee. Certified copies of the marriage license cost $4.00 each. The license is valid for 60 days. The marriage and child support division can be contacted at (765) 668-6542. Applicants may begin the process through the online marriage license application.

Child support. The Grant County Prosecutor’s Office manages child support enforcement matters. The child support division can be reached at (765) 662-2129.

Birth and death records. Although not court records, vital records are frequently requested alongside family court documents. The Grant County Health Department, Vital Records Division, issues certified birth and death certificates for events that occurred in Grant County.

Fees and procedures for vital records:

  • Certified birth or death certificate: $15.00 per copy
  • Payment by money order only (personal checks not accepted)
  • Mail requests must include a completed birth certificate application or death certificate application, a photocopy of the requester’s government-issued ID, and a stamped self-addressed return envelope
  • Birth certificates are issued only to the person named on the record or to a parent, guardian, grandparent, sibling, spouse, or adult child

The Indiana State Department of Health also issues certified vital records statewide. Through that office, the initial fee for a birth certificate is $10.00 (each additional copy $4.00), and the initial fee for a death certificate is $8.00 (each additional $4.00). Grant County Probate Court Records

Grant County does not have a standalone probate court. Probate matters—including the administration of decedent estates, will contests, trust proceedings, guardianships, and conservatorships—are handled by the Grant Circuit Court and Superior Courts, with the Clerk of the Courts serving as the official custodian of probate records.

How to access probate records:

  1. Online. Search MyCase using the decedent’s name, the estate case number, or the name of the personal representative. Non-confidential probate filings, including petitions, inventories, accountings, and court orders, are generally available for public viewing.
  2. In person. Visit the Clerk’s Office at 101 E. 4th Street, Marion, IN 46952. The office can locate probate files by estate name or case number. Copy fees apply at $1.00 per page, plus certification fees for certified copies.
  3. By mail. Written requests should include the full name of the decedent, the approximate date of death or year of filing, and the requester’s return address. Enclose applicable fees by money order.

Probate filing fees. Under I.C. § 33-37-4-7(a), the base probate costs fee is $120.00. With statutory surcharges for document storage ($5.00), automated record keeping ($20.00), judicial salaries ($20.00), public defense administration ($5.00), judicial insurance adjustment ($1.00), pro bono services ($1.00), and court administration ($5.00), total probate fees are approximately $177.00. If service of process through the sheriff is requested, an additional $28.00 applies, bringing the total to approximately $205.00.

Common probate filings include:

  • Petition to open an estate (supervised or unsupervised administration)

  • Final accounting and petition for distribution

The Indiana Judicial Branch provides self-service form packets for guardianship, conservatorship, and other probate-related matters, which can be downloaded and filed either on paper or through the e-filing system. Individuals may also submit a formal public records request through the Indiana judiciary’s administrative office for records not available through standard channels.
