Floyd County is located in southern Indiana along the Ohio River, with New Albany serving as the county seat. The county belongs to Indiana’s 52nd Judicial Circuit and operates a multi-court system that includes the Floyd Circuit Court and three Superior Courts, all housed within the City-County Building in downtown New Albany. The Floyd County Clerk of Courts maintains the official records for every civil, criminal, domestic, and probate case filed in these courts. Case documents range from initial complaints and motions to final judgments and sentencing orders, and most are accessible to the public through both in-person and electronic channels.
Indiana court records can be searched through a combination of official clerk office visits, statewide electronic databases, and local online tools. The Indiana Judiciary provides the MyCase portal for statewide case lookups, and IndianaStateCourts.us may also help users locate publicly available case information from courts across the state. The Floyd County Clerk’s Office offers direct assistance by phone, email, and in person during regular business hours, and court fines and traffic tickets can be paid through online payment systems.
How to Look Up a Court Case in Floyd County?
Floyd County court cases can be searched online, in person, or by contacting the Clerk’s Office by mail, phone, or email. Each method has distinct advantages depending on the level of detail needed and whether certified copies are required.

The primary electronic tool is MyCase, a statewide case information system maintained by the Indiana Judiciary. Users can search by party name, attorney, case number, or citation number, with options to filter by court, case type (criminal, civil, domestic relations, probate), case status, and filing date range. The system displays case parties, charges, bond details, docket entries, hearing dates, and — for many cases — downloadable documents.

Are Court Records Public in Floyd County?
Indiana law establishes a strong presumption of public access to court records. Indiana Code 5-14-3-3 (the Access to Public Records Act) declares that records maintained by public agencies, including courts, must be made available for inspection and copying upon request. The Floyd County Clerk’s Office is required to provide access to court documents to any requesting party, subject to certain statutory exceptions.
Records that are restricted from public access include:
- Sealed and expunged records — Criminal records that have been sealed or expunged pursuant to a successful petition are no longer available for public inspection.
- Juvenile proceedings — Most records involving minors adjudicated in the juvenile division are confidential.
- Personal identifying information — Social Security numbers, financial account numbers, and medical details contained in case files may be redacted before disclosure.
- Confidential informant and victim information — Identifying details of confidential informants, victims, and witnesses in certain cases are protected.
- Child welfare records — Documents relating to child custody, visitation, and support proceedings carry heightened confidentiality protections.
- Domestic violence proceedings — Certain filings in domestic abuse cases may be restricted to protect victim safety.
- Adoption records — Adoption files are generally sealed and accessible only to authorized parties or by court order.
When restricted records are requested, the Clerk’s Office may provide a redacted version with protected information removed. Authorized parties such as attorneys of record, law enforcement, and the individuals named in a case may have broader access than the general public. If a request is denied, the requester may challenge the denial under Indiana’s public records statutes.

The Floyd Circuit Court and Superior Court 1 share felony and domestic-violence-related misdemeanor cases, with the Circuit Court handling approximately 25% and Superior Court 1 handling 75% of these filings. Superior Court 2 adjudicates all Motor Vehicle Code offenses and traffic violations and operates a Probation Department and an Alcohol and Drug Services Program. Superior Court 3 manages cases involving veterans and adult problem-solving court participants through programs such as the Veterans Court of Southern Indiana.
Searching Criminal Case Records
To locate criminal court records, use the MyCase portal and select the “Criminal” or “Citation” case type when searching. The Clerk’s Office at (812) 948-5411 can also confirm case status and provide copies.
Arrest Records and the Sheriff’s Office
The Floyd County Sheriff’s Department maintains arrest records and operates the county jail at a separate location from the courthouse:

The Sheriff’s Inmate Information page provides details on bond procedures, visitation, and commissary deposits. Crash reports completed by Sheriff’s Office patrol officers can be purchased in person for $8.00 or online for $12.00.
The New Albany Police Department also maintains its own arrest records, which can be requested through its records division during business hours.
Statewide Criminal History Searches
The Indiana State Police offers two tiers of criminal history searches. A Limited Criminal History search produces records of felony and Class A misdemeanor arrests statewide, requires the subject’s name, date of birth, Social Security number, gender, and race, and costs $15.00 per record online (subscribers) or $15.70 per record by credit card. Requesters must create a subscriber account to use the system. A Full Criminal History search, available for individuals challenging their own records, requires fingerprint submission for exact-match results. The ISP also provides a national criminal history search for background checks extending beyond Indiana.
Online Fine and Ticket Payments
Traffic tickets can be paid online — allow at least two weeks after the citation is issued for the officer’s report to reach the Clerk. Court fines for criminal cases can be paid through the PayGov portal.
Floyd County Civil Court Records
Civil matters in Floyd County are distributed across the courts according to case type and dollar amount, as set out in the Floyd County Local Rules of Practice.
Case Assignment

Mortgage foreclosure, eviction, civil plenary, civil tort, and miscellaneous civil matters are shared between the Circuit Court (25%) and Superior Court 3 (75%). Small claims cases are filed through the Clerk’s Office and assigned accordingly. Superior Court 1 does not hear small claims, probate, trust, or juvenile cases — its civil docket consists primarily of larger civil disputes alongside its felony criminal caseload.

Floyd County Family Court Records
Family law proceedings in Floyd County encompass divorce, dissolution of marriage, paternity, child custody, child support, protection orders, and adoption. These matters are divided among the courts, with divorce cases shared between the Circuit Court and Superior Courts and paternity cases carrying their own filing track.
Divorce and Dissolution
Divorce filings require a $177.00 filing fee and are processed through the Clerk’s Office. Indiana law requires a minimum 60-day waiting period from the date a case is filed before a divorce can be finalized. If the parties file a written agreement, waiver of rights, and decree of dissolution, a hearing may not be necessary; otherwise, a hearing date must be set after the 60-day period. The Clerk’s domestic relations records include complaints, settlement agreements, custody orders, child support worksheets, and final decrees. Certified copies of divorce judgments can be obtained from the Clerk’s Office or through the Records Department by mail.
Child Support
All non-cash child support payments must be made through the Indiana State Central Collections Unit (INSCCU) or by calling (866) 972-9427. Payment histories can be accessed online. For marriage records before 1938, contact the Marriage Clerk at (812) 542-3018.
Birth and Death Certificates
Birth and death records are maintained by the Floyd County Health Department, not the court system. Indiana law (IC 16-37-1-8) limits issuance of certified birth certificates to the person named on the record (if over 18), parents, grandparents, siblings over 18, spouses, adult children, and legal guardians. Each certified copy costs $15.00.
Requests can be made in person with valid ID, online through VitalChek (credit card required; additional processing fees apply), or by mail. Mail requests require a completed birth certificate application signed before a Notary Public, payment by cashier’s check or money order payable to Floyd County Health Department, a copy of identification, and a self-addressed stamped envelope. Send to:
Floyd County Health Department
1917 Bono Road

Types of Probate Records
The Circuit Court maintains records for supervised and unsupervised estate administration, will probate, trust disputes, guardianship appointments, conservatorship proceedings, and related filings such as inventories, accountings, and claims against estates.

Practical Guidance for Probate Searches
When searching for estate records, the decedent’s full legal name and approximate date of death will produce the most accurate results. For guardianship matters, the ward’s name or the petitioner’s name can be used. If you need to confirm whether a will was filed or an estate was opened, the Clerk’s Office can check its records by phone at (812) 948-5411. The Circuit Court’s offices are located in Room 413 on the fourth floor of the City-County Building, and the judge’s chambers are in Room 417. Court staff cannot provide legal advice, but they can confirm case status, hearing dates, and procedural requirements for filing new probate matters.
