Delaware County occupies a central position in east-central Indiana, with the city of Muncie serving as its county seat. The county’s court system includes five circuit courts and Muncie City Court, each handling distinct categories of criminal, civil, family, and probate matters. Records from these proceedings — case filings, docket entries, motions, orders, judgments, and sentencing documents — are maintained by the Clerk of the Delaware Circuit Courts at the Delaware Justice Center on South Tillotson Avenue.

Indiana provides multiple pathways for locating court case information, from county clerk offices and courthouse visits to statewide digital resources. The Indiana courts website at IndianaStateCourts.us can assist users in finding publicly available case data and connecting with local court offices. The MyCase portal, operated by the Indiana Supreme Court, offers free online searches of non-confidential case information across all Indiana trial courts, including Delaware County. Records can also be obtained directly from the clerk’s office during business hours or through written requests submitted by mail.

How to Look Up a Court Case in Delaware County?

The Clerk of the Delaware Circuit Courts is the official custodian of all trial court records in Delaware County. The clerk’s office processes and files new cases across all divisions — civil, criminal, family relations, probate, and small claims — and prepares certified copies of court documents.

Searching online. The Indiana Supreme Court’s MyCase portal provides free public access to non-confidential case information and many court documents across all Indiana counties, including Delaware County. Users can search by case number, party name, or attorney name. Many orders, judgments, and filings are available as downloadable documents directly on the platform. Financial summaries may also appear, though they may not reflect the most current balance — contact the clerk’s office for official financial information.

Searching in person. Visitors can request records at the clerk’s office in the Delaware Justice Center during business hours. Staff can assist with locating case files, and copies can be made on site. The clerk’s office is prohibited from providing legal advice per Indiana Code 33-43-2-1, but a Self Help Legal Center operates within the Justice Center for those who need assistance with forms or procedures. Copy fees. Indiana Code sections 33-37-5-1 and 33-37-5-3 require the clerk to collect the following fees:

  • Standard copies: $1.00 per page
  • Certification fee: $3.00 per document (in addition to copy costs)

Requesting copies by mail. The clerk’s office accepts mail-in requests for court records and marriage licenses. Requesters should complete the appropriate request form (available on the Copies of Records page), include the applicable fee by check or money order payable to the Clerk of Delaware County, and mail everything in a self-addressed, stamped envelope to:

E-filing. Since September 2017, electronic filing has been mandatory for all practicing attorneys in Delaware County. Pro se litigants may choose to e-file or submit paper filings at the Clerk’s Filing Office in the Justice Center. For e-filing information, visit the Indiana e-filing page. Are Court Records Public in Delaware County?

Indiana law establishes a general presumption that court records are open to public inspection. The Indiana Access to Public Records Act (IC 5-14-3) requires government agencies, including courts, to allow access to public records in their custody. Court-specific access rules are governed by the Indiana Rules on Access to Court Records, adopted by the Indiana Supreme Court and most recently updated effective February 2, 2026.

Under Rule 5 of the Access to Court Records Rules, the following categories of records are excluded from public access:

  • Entire cases declared confidential by statute or court rule, or sealed under the Access to Public Records Act
  • All mental health cases filed under IC 12-26
  • Cases pertaining exclusively to investigative requests unrelated to a pending criminal proceeding, including search warrants and subpoenas
  • Paternity records created between July 1, 1941 and July 1, 2014
  • Records declared confidential by federal law
  • Medical records compiled by a medical service provider or examiner reports under Trial Rule 35
  • Mental health and substance abuse treatment records (including those governed by 42 CFR Part 2)
  • Guardian ad litem, court-appointed special advocate, parenting coordinator, and custody evaluation reports
  • Photographs or recordings depicting certain private content
  • Personal information including complete Social Security numbers, account numbers, PINs, and passwords (which must be redacted)
  • Names of child witnesses in sex offense cases
  • Addresses, dates of birth, and phone numbers of witnesses or victims in criminal, juvenile, or civil protection order cases

Protection order cases are excluded from online access by federal law and cannot be found on MyCase. A separate Protection Order Search tool is available. Expunged cases may be removed from public access once an expungement has been granted.

When a document contains both public and confidential information, the confidential portions must be redacted, with the public version filed separately. Confidential documents are filed on green paper (for paper filings) or marked as confidential in the e-filing system, accompanied by an ACR Form identifying the grounds for exclusion.

Delaware County Criminal Court Records

Criminal cases in Delaware County are heard across the five circuit courts and Muncie City Court, depending on the severity of the charges. The circuit courts handle felony prosecutions and serious misdemeanors, while Muncie City Court adjudicates criminal misdemeanors, state infractions, and city ordinance violations. Despite its name, Muncie City Court has geographical jurisdiction across all of Delaware County.

Searching criminal court records. The MyCase portal allows free searches of public criminal case information by defendant name, case number, or attorney name. Final orders and judgments in criminal cases are typically available as downloadable documents. Case details from Muncie City Court are also available through MyCase.

Sheriff’s Office records. The Delaware County Sheriff’s Office is located within the Justice Center and can be contacted for arrest records, warrant information, and criminal history inquiries.

Indiana State Police criminal history checks. The Indiana State Police provides Limited Criminal History (LCH) reports, which contain felony and misdemeanor arrest data from within Indiana only. These name-based searches can be performed:

  1. Online at the ISP Limited Criminal History portal — the fee is $15.00 for subscribers or $16.32 for credit card users.
  2. By mail — complete the LCH Request Form, include a money order payable to the State of Indiana, and mail to: Indiana State Police, Criminal History Limited Check, P.O. Box 6188, Indianapolis, IN 46206-6188.

Prosecutor’s Office records. The Delaware County Prosecutor’s Office requires all public records requests to be made using its designated request form, available on the county website.

Delaware County Civil Court Records

The Delaware County Circuit Courts exercise broad civil jurisdiction, handling general civil disputes, commercial litigation, landlord-tenant actions, and small claims. There are no separate superior or district courts in the county; the five circuit courts collectively manage the full civil docket.

Obtaining civil records. Civil case filings, pleadings, motions, orders, and judgments are maintained by the Clerk of the Circuit Courts. Records can be obtained in person at the clerk’s office at the Delaware Justice Center during business hours (Monday–Friday, 8:30 a.m.–4:00 p.m., closed noon–1:00 p.m.) or searched online through MyCase. Orders in many civil case types are available for free download on MyCase. Standard copy fees of $1.00 per page and $3.00 per certification apply.

Small claims. Small claims cases are filed and managed through the circuit court system. Filing fees and court costs must be paid at the time of filing. A complete schedule of filing fees is published by the clerk’s office on the county website.

E-filing. Attorneys must e-file all civil cases. Pro se litigants may file on paper at the clerk’s Filing Office or use the e-filing system. Visit the Indiana e-filing information page for instructions and access.

Property records. Real property assessments and ownership data are maintained by the Delaware County Assessor’s Office at 100 W. Main St., Muncie, IN 47305, Phone: (765) 747-7710. Property records can also be searched online through the Beacon property search portal. Tax payment information is available through the Delaware County Treasurer’s parcel search.

Delaware County Family Court Records

Family law matters in Delaware County are adjudicated by the circuit courts, which handle divorce, child custody, child support, paternity, guardianship, and termination of parental rights. There is no standalone family court division; these cases are assigned across the five circuit courts.

Accessing family court records. The clerk’s office maintains all family relations case files. Records can be requested in person at the Delaware Justice Center, by mail using the appropriate request form, or searched online via MyCase. Note that certain family law records — particularly guardian ad litem reports, parenting coordinator reports, and custody evaluation reports — are excluded from public access under Rule 5(B)(13) of the Indiana Rules on Access to Court Records. Juvenile paternity cases filed before July 1, 2014 remain confidential, though records entered on or after that date in those cases are considered public unless otherwise excluded.

Marriage licenses. The Clerk of the Circuit Courts processes marriage applications and issues licenses. Both applicants must appear in person at the clerk’s office with valid identification proving date of birth. The statewide fee is $25.00 for Indiana residents and $65.00 for out-of-state residents. Some counties charge an additional $4.00 document fee. Each certified copy of a marriage license costs $4.00. Indiana marriage licenses are valid for 60 days and couples may marry as early as the same day the license is issued.

Applicants can begin the process through the Indiana Courts online marriage application, though both parties must still appear at the clerk’s office in person to complete the process and receive the license. Previously married applicants must provide the date their prior marriage ended.

The Indiana Supreme Court maintains a Marriage License Public Lookup portal for searching marriage licenses issued from 1993 to the present by county, applicant name, and year range.

Divorce records. Divorce cases fall under the exclusive jurisdiction of the circuit courts. Records can be searched via MyCase or obtained from the clerk’s office in person or by mail. To request a divorce record by mail, complete the divorce record request form, include a check or money order payable to the Clerk of Delaware County ($4.00 for a certified copy or $1.00 per page for photocopies), and mail in a self-addressed, stamped envelope to the clerk’s office.

Birth and death certificates. The Delaware County Health Department Vital Records Division issues birth and death certificates. The office is located at 125 N. Mulberry St., Muncie, IN 47305 (one block east of the Delaware County Building). Photo ID is required, and appointments are encouraged for certain services.

Payment options include cash, check, and money order only — personal checks and electronic payments are not accepted. The Indiana Department of Health Vital Records office also issues birth certificates ($10.00 per copy, $4.00 each additional) and death certificates ($8.00 per copy). Delaware County Probate Court Records

Probate matters in Delaware County are handled by the circuit courts rather than a separate probate division. The courts oversee the administration of decedents’ estates, validation of wills, guardianship and conservatorship appointments, and name change petitions.

Searching probate records. Probate case information is available through MyCase, where users can search by the decedent’s or petitioner’s name or by case number. Many probate orders and filings are accessible online at no charge. For documents not available through MyCase, the clerk’s office can provide copies in person or by mail at the standard rate of $1.00 per page plus $3.00 for certification.

What probate records include. Probate files may contain last wills and testaments, petitions for administration, inventories of estate assets, accountings, orders appointing personal representatives, guardianship and conservatorship petitions and orders, and final settlement documents. Name change petitions and related orders are also part of the probate docket.

Confidentiality considerations. Most probate records are public and can be freely inspected. However, documents containing information that falls under Rule 5 exclusions — such as Social Security numbers, financial account numbers, or medical records — will be redacted or filed confidentially. Inheritance tax files are listed among the records excluded from public access under Rule 10 of the Indiana Rules on Access to Court Records. If a probate case involves a guardianship of an incapacitated person, portions of the record related to mental health evaluations or treatment may also be restricted.

Filing probate petitions. Filing fees must accompany the initial petition. A current schedule is available from the clerk’s office or on the county filing fees page.
