The county’s court system consists of six circuit courts, the Clarksville Town Court, and a range of administrative offices housed primarily at the Clark County Judicial Center. The Clark County Clerk of Courts serves as the official custodian of all trial court records, managing filings, judgments, orders, and transcripts generated across each division. Whether a matter involves a felony prosecution, a contested divorce, or the probate of an estate, the resulting paperwork is indexed and maintained by the Clerk’s office.
Residents and members of the public who need to locate Indiana court records can do so through several channels. The statewide MyCase portal, operated by the Indiana Office of Judicial Administration, allows free online searches of non-confidential case information across all participating counties. For records not available electronically, requesters may contact the Clerk’s office directly, visit the courthouse during business hours, or submit a written request by mail.
How to Look Up a Court Case in Clark County?
There are three primary ways to search for a court case in Clark County: online through MyCase, in person at the courthouse, or by contacting the Clerk’s office by phone or mail.
Online via MyCase
The MyCase search tool lets anyone look up public case records at no charge. Searches can be filtered by party name, case number, case type, filing date range, and court location. Many non-confidential documents, including orders, judgments, and certain motions, are viewable directly through the portal. Attorneys who log in with a Courts Portal account gain access to additional documents. Protection order cases are not searchable on MyCase due to federal privacy requirements; those can instead be found through the Protection Order Search.
In Person
The Clerk’s office is located inside the Clark County Judicial Center. Walk-in visitors may search records at the counter or request copies of specific filings. Identification may be required for certain confidential records. The marriage license search tool on the Indiana Marriage License Public Lookup provides online access to marriage records from 1993 forward.

Are Court Records Public in Clark County?
Indiana law establishes a strong presumption of public access to court records. The Indiana Access to Public Records Act (Indiana Code 5-14-3) guarantees the right to inspect and copy public records held by government agencies. For court-specific records, the Indiana Supreme Court’s Rules on Access to Court Records govern what is publicly available, what is confidential, and how exclusions are handled.
Records open to the public include:
- Civil case filings, docket entries, orders, and judgments
- Criminal charging documents, plea records, sentencing orders, and final judgments
- Probate petitions, estate inventories, and letters of administration
- Divorce decrees and dissolution filings
- Marriage license records
- Traffic and infraction case records
Records excluded from public access under Access to Court Records Rule 5 include:
- Entire mental health cases filed under IC 12-26
- Sealed and expunged case records
- Juvenile CHINS, status, and termination of parental rights records (within Circuit Court No. 4)
- Adoption case files
- Guardian ad litem reports, custody evaluation reports, and parenting coordinator reports
- Medical and mental health treatment records submitted as exhibits
- Social Security numbers and complete account numbers (must be redacted)
- Witness and victim addresses, dates of birth, and phone numbers in criminal and protection order proceedings
Confidential filings in Clark County must be submitted on green paper (for paper filings) or designated as confidential through the e-filing system, accompanied by an ACR Form identifying the specific rule authorizing the exclusion. Any person who believes a record has been improperly withheld or improperly disclosed may petition the court for review.
Clark County Criminal Court Records
Criminal cases in Clark County are distributed among multiple courts based on the severity of charges and the nature of the offense. Circuit Court No. 1 and Circuit Court No. 4 handle murder and serious felonies on an alternating monthly schedule. Circuit Court No. 2 presides over felony drug offenses brought under IC 35-48. Circuit Court No. 3 covers Level 6 and Class D felonies as well as OWI-related cases under Title 9, Chapter 30. Superior Court No. 5 handles most misdemeanor cases, while the Clarksville Town Court has jurisdiction over misdemeanors committed within the town limits.

- Statewide background checks: The Indiana State Police Limited Criminal History search provides name-based Indiana criminal history reports. The online fee is $16.32 (including a processing surcharge); mail-in requests cost $7.00 and should be sent to ISP Criminal History Administration at 100 N. Senate Avenue, Suite N302, Indianapolis, IN 46204. National fingerprint-based checks cost $38.20 for employees and $36.20 for volunteers, including a $11.95 IDEMIA fingerprint fee.
Sheriff’s Office records: The Clark County Sheriff’s Office maintains arrest records, incident reports, and jail records. Records requests can be submitted through the Sheriff’s records request page; inspection of records is available at the records division during business hours.
Expungement of criminal records in Indiana is governed by IC 35-38-9. Cases that have been expunged are removed from MyCase and are no longer publicly accessible, though law enforcement and certain authorized entities may retain limited access.
Clark County Civil Court Records
Civil matters in Clark County are allocated across several courts based on case type. Superior Court No. 6 handles mortgage foreclosures, civil collection actions, civil tort claims, civil plenary cases, and eviction proceedings. Small claims cases (amounts up to $10,000) are also filed in Superior Court No. 6.

A $10 service fee applies for each additional defendant beyond the first. Sheriff service of process costs $28 per case before judgment and $28 after judgment. For non-Indiana cases requesting sheriff service, the fee is $60. Civil filings can be submitted electronically through Indiana’s E-Filing system.
Property and real estate records in Clark County are maintained by the Recorder’s Office, not the Clerk of Courts. The Recorder holds deeds, mortgages, liens, easements, UCC filings, and plats. Public searches of recorded documents dating to November 1999 are available through the Tapestry online search tool. Recording fees at the Recorder’s Office are $25 for deeds and most instruments and $55 for mortgages. Copies are $1 per page (11×17 or smaller) or $5 per page for oversized documents, plus $5 for certification.
Clark County Family Court Records
Family law matters in Clark County are primarily handled by Superior Court No. 5, which presides over all domestic relations cases including divorce with children (DC) and divorce without children (DN). Superior Court No. 6 manages reciprocal support and Title IV-D child support enforcement cases. Circuit Court No. 4 oversees juvenile paternity, CHINS (Child in Need of Services), juvenile status offenses, termination of parental rights, and child guardianship. Adoption cases are shared equally among all six courts, with one-sixth of filings assigned to each.

Marriage records: The Clerk’s office issues marriage licenses and maintains all recorded marriages in Clark County. Fees are $29 for Clark County residents ($25 license + $4 document fee) and $69 for out-of-state residents ($65 + $4). Both applicants must appear in person with acceptable identification. The application process can be started through the online marriage license portal, and appointments for courthouse ceremonies can be scheduled through the Clerk’s scheduling page. Birth and death records: These are maintained by the Clark County Health Department, located at 1201 Wall Street, Jeffersonville, IN 47130, Phone: (812) 282-7521 Birth certificates are restricted to eligible family members and legal representatives; requesters must present valid identification and a completed birth certificate application. Death certificates require a completed death certificate form. For genealogy searches, the Health Department charges a $5 non-refundable search fee for up to five names, with additional fees of $12 per certified birth copy and $15 per certified death copy. Records are also available through VitalChek for online orders or through the Indiana Department of Health Vital Records office (first copy $8, additional copies $4 each). The CASA program, operating under Circuit Court No. 4, provides court-appointed special advocates for children in abuse and neglect cases (CASA of Clark County).
Clark County Probate Court Records
Probate jurisdiction in Clark County rests with Circuit Court No. 1, which handles supervised and unsupervised estate administration, trust matters, and adult guardianship cases. Circuit Court No. 4 handles guardianship cases involving minors.

The Adult Guardianship Program, administered through Circuit Court No. 1, serves as guardian for individuals who have been ruled incapacitated and have no suitable person to act on their behalf. The program recruits volunteer advocates and can be reached at (812) 285-6383.
Probate case records, including wills admitted to probate, letters testamentary, estate inventories, accountings, and guardianship reports, are generally public unless sealed by court order. Case information can be searched through MyCase by entering the case number or party name and selecting the estate or guardianship case type filter.
