Are Court Records Public in Cass County?

Indiana’s Access to Public Records Act (APRA), codified at Indiana Code § 5-14-3, establishes the public’s right to inspect and copy records held by government agencies, including courts. The Indiana Rules on Access to Court Records reinforce this framework — under these rules, court records are presumed publicly accessible unless a specific exclusion applies.

Rule 5 of the Indiana Access to Court Records Rules identifies the categories excluded from public access:

  • Records declared confidential by state or federal statute, including certain juvenile and adoption records
  • Sealed records pursuant to a court order
  • Entire criminal cases during pending proceedings in specific circumstances
  • Mental health case records filed under Indiana Code § 12-26
  • Records relating to pre-trial release, supervision, and problem-solving court supervision
  • Medical records created or compiled pursuant to Trial Rule 35
  • Information redacted from public documents, such as Social Security numbers, financial account details, and addresses of protected parties

Records that are not excluded under these provisions — including most civil judgments, divorce decrees, criminal case dispositions, and probate filings — are open for public inspection and copying. The Indiana Judicial Branch’s Public Access to Court Records Handbook provides detailed guidance on what is and is not accessible.
